This is a consolidated appeal from a decision of the Court of Common Pleas of Lackawanna County dismissing preliminary objections filed by five property owners (Condemnees) to declarations of taking filed by the Scranton Redevelopment Authority (Redevelopment Authority) to condemn properties they owned on Lackawanna Avenue in the City of Scranton. 1 The declarations of taking were filed by the Redevelopment Authority to implement the Lackawanna Avenue Redevelopment Area (Project Area) which was adopted pursuant to the procedures set forth in the Urban Redevelopment Law, Act…
