After this case was tried in the Court of Common Pleas for Richland County, resulting in a mistrial, the defendant interposed a demurrer to the complaint upon the ground that it did not state facts sufficient to constitute a cause of action. The demurrer was overruled by Honorable W. H. Townsend, Circuit Judge; no reasons being given for his order. Prom the order overruling the demurrer, the defendant appealed to this Court.
