Appeal by the defendant, William De Forest Manice, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the cleric of the county of New York on the 15th day of May, 1899, upon the verdict óf a jury for $22,500, and also from an order entered in said clerk’s office on the 24th day of May, 1899, denying the defendant’s motion for a new trial made upon the minutes.

Patterson, J.:

The plaintiff sues as administratrix to recover damages for the death of her intestate (her husband), which she claims was caused by the negligence of the defendant.
