This was an action by a mortgagee to replevin an automobile. The Municipal Court of Toledo after an extended trial entered judgment for the plaintiff which.was affirmed by the Court of Common Pleas and defendant filed this appeal on questions of law.

There is little dispute about the essential facts and they could have been stipulated in a few pages of record, but nearly four hundred pages of testimony were taken, and many exhibits were received.
