Appeal by the defendant from a judgment of the Supreme Court, Westchester County (Zambelli, J), rendered August 16, 2012, convicting him of falsely reporting an incident in the third degree, upon a jury verdict, and imposing sentence.
Ordered that the judgment is affirmed.
The defendant’s contention that the instant prosecution is barred by the double jeopardy statute (CPL 40.20) because it is based upon the same alleged act that was the basis of a count in a federal indictment and prosecution of the defendant is without merit.
