In this case,1 the court is presented with defendant’s motion for summary judgment and plaintiff’s cross-motion for summary judgment regarding plaintiff’s, the mother of a deceased police officer from Denver, Colorado, request for review of an administrative decision denying her survivor’s death benefits under the Public Safety Officers’ Benefits Act, Pub.L. No. 94-430, 90 Stat. 1346 (1976), as amended, 42 U.S.C. §§ 3796-3796C (Supp. Ill 1979) (“PSOBA”).
