This astonishing decision .of-the majority compels me to stoutly dissent for the following reasons:

The state of Ohio brought this action against John D.’ Herbert, former Treasurer of State, Robert F. Gardner, former deputy Treasurer of State, and six sureties to recover interim funds of the state which had been invested in commercial paper notes, pursuant to R. C. 135.14.
