On March 29, 2001, plaintiffs David and Coleen Sutton (“the Suttons”) filed an amended complaint against the Small Business Administration (“SBA”) on the following five claims: 1) declaratory, injunctive, and monetary relief against the SBA on the ground that its foreclosure on plaintiffs’ property was faulty because the SBA lacked title or interest in the property due to the mortgage having been altered without plaintiffs’ authorization; 2) declaratory and monetary relief against the SBA on the ground that it denied plaintiffs, both of whom are black, equal protection…
