I. FACTS AND BACKGROUND
Plaintiff brings this action pursuant to the Fair Labor Standards Act, 29 U.S.C.A. § 201 et seq. Plaintiff is a former employee of Defendant. Defendant Precision Door of Akron is a franchise operation that is in the business of installing and repair ing automatic garage doors. (Doc. 33, at 2; Defendant’s Exhibit b [hereinafter, “LybrookDep.”], at 5).
