The question whether at the time of the conveyance from Taylor to Waterman (September 22, 1858) the premises described therein extended to the waters of the late at ordinary low-water mark was purely a question of fact, upon which the evidence is conflicting, and the finding of the trial court is challenged on the ground only that it is against the clear preponderance of the credible evidence.
