Baker, Chief Justice:

This is an action in tort for damages, actual and punitive, alleged to have been suffered by the appellant when the respondent, Martin, the general man ager of a dairy ■ and farm owned and operated by his corespondent, Mrs. Elbert, on the 15th day of March, 1942, committed assaults and batteries upon him.

Upon a trial of the case, the trial Judge directed a verdict in favor of Mrs. Elbert, but submitted the issues to the jury as to Martin. The jury rendered a verdict in favor of appellant for $200.00 actual damages and $200.00 punitive damages against this respondent.
