MEMORANDUM
JOSEPH H. YOUNG, District Judge.
This case presents the question of what constitutes waiver of a venue defense under Rule 12 of the Federal Rules of Civil Procedure. On October 11,1983, plaintiffs, seven firefighters employed by the federal government and working in Maryland, sued Donald J. Devine, Director of the U.S. Office of Personnel Management, Raymond Donovan, Secretary of Labor, and the United States. Before defendants responded to the complaint, plaintiffs filed a First Amended Complaint eliminating certain claims contained in the original complaint. See Fed.R.Civ.P. 15(a).…
