CHAPMAN, Justice.

This is a summary judgment case. Ap-pellee, C. H. Kuper, brought suit in the court below against L. J. Schmidt and L. W. Schmidt and Schmidt Brothers, a partnership, composed of the two brothers just named, on two promissory notes executed by L. J. Schmidt and L. W. Schmidt. The note designated in the record as Exhibit A was in the principal sum of $7,148 dated December 31, 19S3, payable to the order of C. H. Kuper and due twelve months after date.
