These two cases are proceedings by direct appeal from a judgment of the district court of Laramie County. As they are based upon the same record and were briefed and argued together one opinion will suffice to dispose of both. For convenience the parties will be referred to, the plaintiff and respondent, City of Casper, as the “City” or the “plaintiff,” and the defendants below and appellants here, LeRoy Joyce, as the “Treasurer” or by his surname, and the Central Surety and Insurance Corporation of Kansas City, Missouri, a corporation, as the “surety.” The facts material…
