STATEMENT OF THE CASE

In April 1999, James A. Mellowitz filed a Complaint for Declaratory Relief against Ronald W. Frazier, seeking a determination from the trial court that Frazier had breached the terms of the parties' litigation referral agreement and that Mellowitz owed Frazier nothing under the terms of that agreement. In June 2002, Mellowitz filed a Motion for Summary Judgment, and on April 10, 2008, the trial court granted that motion.
