Appellees filed a petition with the auditor of Marion county praying for the location and construction of a public highway. Appellants, Benard and Benard and Boberson and Bobm'son, whose lands would be affected by the proposed highway, appeared before the board of commissioners and moved to dismiss the petition upon the ground that the board did not have jurisdiction over the subject-matter, which motion • was overruled.
