On the 6th day of June, 1891, appellee, the Pittsburgh, Cincinnati, Chicago & St. Lonis Railway Company, instituted this action, making the appellants, the trustee of Center township, Marion county, Ind., the supervisor of road district number two, and the board of public works of the city of- Indianapolis, defendants thereto, whereby it *234sought to enjoin the opening of a certain public highway crossing the tracks of appellee’s railroad.
