ROBERTS, Judge.

The jury returned a verdict finding defendant guilty of manslaughter in the second degree and from the judgment thereon he has appealed.

Defendant was arrested on October 16, 1967. He had a preliminary hearing on November 6 and 7, 1967, at which defendant was represented by court appointed counsel who continued to represent him at the trial and on appeal. Defendant was arraigned on an information charging that he "wilfully and unlawfully, and feloniously did kill a human being, to-wit: Pedro Maestas, said killing being perpetrated without a design to effect death and in a heat…
