HENDERSON, Justice.

ACTION

George Ronald Wolford (appellant) appeals from a conviction of grand theft resulting from a bench trial. Sentenced to three years imprisonment, he raises three issues which are treated below. We affirm.

FACTS

During the evening hours of May 14, 1981, appellant, Jerry Watts, Doris Jones and Laurie Lehman were riding in Watts’ pickup truck in Huron, South Dakota, when it ran out of gas.
