*999Appeal from an order of the Supreme Court, Erie County (John E Lane, J.), entered July 9, 2004. The order, insofar as appealed from, granted in part the cross motion of plaintiffs for leave to amend the complaint and denied the cross motion of defendants for summary judgment dismissing the complaint.

It is hereby ordered that the order insofar as appealed from be and the same hereby is unanimously reversed on the law without costs, plaintiffs cross motion is denied in its entirety, defendants’ cross motion is granted and the complaint is dismissed.
