MEMORANDUM AND ORDER

WEXLER, District Judge.

This is a civil rights action commenced by Jeffrey Johns (“Johns” or “Plaintiff’) alleging a violation of his rights pursuant to the Fourteenth Amendment to the United States Constitution. Plaintiffs claims arise from the allegation that the Lower Manhattan Development Corporation (“LMDC”) failed to properly consider Johns’s submission in connection with a contest held to design a memorial at the World Trade Center Site.
