MEMORANDUM OPINION

RUFE, District Judge.

This is a federal civil rights action brought against a Pennsylvania State Police Trooper, Marcus Hambrick (“Ham-brick”), in his individual capacity. Plaintiff Adam Ankele (“Ankele”) contends that Hambrick violated his Fourth and Fourteenth Amendment rights under the U.S. Constitution following a February 12, 2001 vehicular accident and subsequent investigation.
