The plaintiff filed a petition under 42 U.S.C. § 405(g) wherein she alleged that the defendant wrongfully denied the plaintiff certain widow’s insurance benefits under the Social Security Act. The defendant answered denying that the plaintiff was the lawful widow of Eber A. Hawkins and has submitted a certified copy of the record from the Appeals Council, Social Security Administration, wherein the Appeals Council denied the claim of the plaintiff and awarded the benefits to another.
