This case arises from the revocation of plaintiff Dr. Khaiid Said Mohammad’s approved Form 1-140 Immigration Petition (“1-140 Petition”) by the United States Citizenship and Immigration Services (“USCIS”). Pursuant to Section 10b of the Administrative Procedure Act (“APA”), 5 U.S.C. § 702 and 28 U.S.C. § 1331, plaintiff is seeking a determination that the revocation of his approved I-140 Petition was arbitrary and capricious.
