OPINION

BRUGGINK, Judge.

This action is part of a consolidated group of cases arising out of termination by the United States Forest Service (“Service” or “Forest Service”) of timber sales contracts in the Northwest during the 1980’s. Seaboard Lumber Company (“Seaboard”), along with other companies, brought actions under the Contract Disputes Act1 in an effort to have their non-performances of contract declared legally excused and to have the Service’s claims reduced or set aside.
