These appeals involve three separate cases. Case No. S-89-1144 was filed in Custer County, Nebraska; case No. S-89-1345 was filed in Dawson County; and case No. S-89-1347, in Buffalo County. Since the cases involve similar questions, they will be considered together. Both defendant-appellant, Union Pacific Railroad Company (hereinafter Railroad), and plaintiff-appellee, State of Nebraska, Department of Roads (hereinafter State), filed motions for summary judgment in each case.
