On the 20th day of February, 1930, the defendant Harold J. Craugh was arrested by a police officer of the city of *225Geneva, N. Y., charged with a violation of section 1530 of the Penal Law of the State of New York, the charge being that he was maintaining a public nuisance.

He was arraigned in the City Court of the city of Geneva. The charge was read to him by the presiding judge of that court. He was advised that he was entitled to a trial by jury.
