KNAPPEN, Circuit Judge.
This writ is prosecuted to review a judgment in favor of the plaintiff for the alleged negligent killing of his intestate. At Grand Junction, Tenn., a small hamlet, the tracks of the Southern Railway Company and of the Illinois Central cross each other at right angles and at grade; those of the Illinois Central running north and south and those of the Southern extending east and west.
