HICKS, Circuit Judge.

William Keith, a railroad engineer, brought this action, based upon the Federal Employers’ Liability Act, 45 U.S.C.A. § 51 et seq., against the Wheeling & Lake Erie Railway Company ('herein called Wheeling) and The Pennsylvania Railroad Company (herein called Pennsylvania) for damages for injuries sustained by him in a collision, resulting from alleged negligence of both defendants.
