Plaintiff-intervenor Confederated Tribes of the Colville Reservation (“Colville”) filed a complaint in intervention seeking injunc-tive relief and a declaration that it is the successor in interest to the Wenatchi, Enti-at, Chelan, Columbia, Palus and the Chief Joseph Band of Nez Perce Indians, and as such, it is entitled to exercise Columbia River off-reservation fishing rights reserved by those tribes in the Treaty at the Walla Walla Valley on June 9, 1855, 12 Stat. 951, II Kapp. 698, ratified March 8, 1859 (“Yakima Treaty”) and the Treaty at Walla…
