The plaintiffs filed their petition in the district court of Garfield county against the defendant as surety to recover from it as surety of the executor’s bond of one A. D. Howard, as executor of the estate of P. H. Bradley, deceased, which suit upon the said bond is based upon the breach of conditions by A. D. Howard, executor, contained in the bond, which bond was given to and approved by the county court of Garfiel'd county, Okia.
