This was an action for the specific performance of an oral agreement made by the mother of the plaintiff with her brother, Patrick Murphy, when the plaintiff was only four and one half years old, to the effect that if plaintiff would go into the home of Patrick Murphy, become a member of his family and reside with him, aid and assist him during his lifetime, then Patrick Murphy would give him all the property he had at the time of his death.
