—This action is by the appellee against the appellant, for damages on account of a personal injury received0 by the plaintiff while a passenger on defendant’s train. The complaint alleges that the “defendant then and there so negligently conducted its said business that, by reason thereof and as a proximate consequence thereof, plaintiff received personal injuries,” in having his foot bruised and injured.
