October 11,1933, the document with which we are now concerned was signed by Plympton J. Kelly. October 18,1933, he died, aged 70 years. The contestants aver that “prior to the 18th day of October, 1933, the said P. J. Kelly was suffering greatly from physical weakness and pain and that the will as made and executed by P. J. Kelly was not the free and voluntary act of the said P. J. Kelly, but was as a result of coercion, duress, undue influence and fraud on the part of Jessie G.
