STEVENS, Judge.

The parties to this appeal were the parties to the trial in the Superior Court. Jack D. Williams dba Williams Trucking Company, hereinafter referred to as Williams, was the plaintiff. A. J. Bayless Markets Inc., an Arizona corporation, herein referred to as Bayless, was the defendant. The Williams claim arose out of the services he rendered in hauling fill used in connection with the construction of a Bayless Market. He was not paid for his services.
