MANTON, Circuit Judge.
The parties will be referred to herein as plaintiff and defendant. The plaintiff contracted, through its rep~ resentative, with the defendant, for the purchase of certain brass discs under terms which are necessary to refer to. The contract was made on July 15, 1917, by one Gen. Tozzi, a member of the Italian Military Mission during the great war, on behalf of the plaintiff.
