May 7, 1920, about 2:30 a. m., the residence of Edwin A. Duff, in Nebraska City, was burglarized, and the plaintiff in error, herein called the defendant, and one William Holmes were arrested as participants therein. June 1, 1920, the county attorney filed an information in the district court for Otoe county against “John Seaton, William Holmes, John Doe, real and true name unknown, John Stiles, real and true name unknown, Richard Roe, real and true name unknown,” charging them with having jointly committed the offense, and the defendant and Holmes entered pleas of not…
