I. Introduction
Pending before the court is a motion for partial summary judgment (“Motion”) (ECF No. 26), filed by defendant Frito-Lay, Inc. (“defendant” or “Frito-Lay”) with respect to claims filed by plaintiffs Nancy Cerutti (“Cerutti”), James Coffman, John Constabile, Matthew Donaldson, Anthony Georgiana, Donald McKnight, Linda Massucci, Michael Massucci, Shaun Christopher, and John Arison (collectively, “plaintiffs”).
