David Harris, appellant herein, sued Western Union Telegraph Company, appellee herein, for dainages for alleged negligent delay in delivering a telegraxffi message announcing the death of his mother. The parties will be designated as in the trial court. The message was delivered to defendant at San Antonio, Tex., for transmission and delivery to plaintiff at Mexia, Tex., by Miss Cameron, a relative of plaintiff, in pursuance of a request on his part to be advised in case of his mother’s death.
