FOLTA, District Judge.

In this suit to foreclose a mortgage, in which the plaintiff has joined the United States as a defendant under the authority of 28 Ú.S.C.A. § 2410, the United States has moved to dismiss the complaint for noncompliance with the provisions of subsection (b) of that statute.

The complaint alleges:

“That the defendants, the United Státes of America, a body politic, and Sullens & Hoss, Inc., a corporation organized and doing business under and by virtue of the laws of the Territory of Alaska, have or claim to have some interest or claim upon said premises or some part thereof…
