Appellee on May 5, 1911, filed her ex parte petition in the trial court, under the terms of §3 of the act of 1907 (Acts 1907 p. 617, §8910 Burns 1914), praying for the vacation of a designated part of a public alley in the city of Eichmond. The petition alleges among other things that the section of alley sought to be vacated is half a block in length, and that petitioner owns all the lands and lots immediately adjoining and abutting thereon.
