This is an action in contract to recover the balance owed on a promissory note signed by the defendant. Although the note was secured by a second mortgage on real estate located in New Hampshire, the proceeds of a foreclosure sale were insufficient to satisfy even the first mortgage, held by Dime Real Estate Services (“Dime”)- In her defense, the defendant asserted that she was not personally liable on the note she signed because she was acting at all times as the disclosed agent of her nephew.
