In separate actions defendants entered pleas of guilty to the offense of possession of marijuana; were granted probation; and appeal. The two appeals were consolidated by this court.

The two actions arose out of the same incident. Both defendants moved to suppress evidence pursuant to Penal Code section 1538.5. Both motions were heard and denied by the Honorable Louis M. Welsh.
