The question here presented is the right of an attorney for one of the parties in an action for divorce to enforce a contract providing for a contingent fee.

On March 5, 1937, Irvin J. Dannenberg commenced an action against his wife, Doris Thompson Dannenberg, for a divorce, alleg-' ing as grounds extreme cruelty and gross neglect of duty, and that a postnuptial contract settling property rights had been entered into.
