OPINION
PICKARD, Judge.
{1} This case raises issues concerning the meaning of, and procedures to be applied under, NMSA 1978, § 33-2-34 (1999), which is known as New Mexico’s Earned Meritorious Deductions Act (EMDA). The EMDA provides in Subsection (A) that prisoners convicted of nonviolent offenses may earn up to 30 days per month of credit for participation in programs, but that prisoners convicted of serious violent offenses may earn only four days per month of credit.
