OPINION

{¶ 1} This is an appeal from a judgment entered by the Geauga County Court of Common Pleas, following a bench trial, against The Illuminating Company, appellant, on its claims against Mr. Larry Podojil, appellee.

{¶ 2} Appellant commenced this action on April 17, 2006, filing a two-count complaint against appellee and Chester Township. Count one of the complaint has been satisfied and is not at issue in the instant appeal.
