Action to recover damages for representing a note and mortgage bought by plaintiff as a second mortgage when in truth it was a fourth, mortgage. Plaintiff had a verdict, and defendant appeals from the order denying a new trial.

The defendant is a national hank at Lakefield, Minnesota, organized by James C. Caldwell in 1907, he being its president and so continuing until 1922. He was a half brother of plaintiff’s father.
