This is an appeal from a judgment dismissing the application of Julian Tugas for a writ of habeas corpus. Mr. Tugas was tried for murder and, by special verdict of the jury, was acquitted by reason of insanity. The jury further found that, although the insanity did not exist at the time of the trial, there was such a likelihood of a relapse or recurrence of the insane or mentally irresponsible condition that Mr. Tugas was not a safe person to be at large.
