This appeal is from an action in trespass to try title. 609 S.W.2d 630 (Tex.Civ.App.1980). The appealing defendants are the heirs of S. M. McCarthy, the son produced by the marriage of P. E. and Christine McCarthy. The plaintiffs are the heirs of Elizabeth McCarthy Lyscio, a daughter born to Christine McCarthy before her marriage to P. E. McCarthy. The defendants have assigned numerous errors to the trial court’s action in awarding the plaintiffs a one-half undivided interest in a 160 acre tract situated in Parker County, Texas.
