Commonwealth Public Service Co. v. City of Deer Lodge

Plaintiff, a taxpayer within the city of Deer Lodge, brought this action against the city to enjoin the issuance of bonds in the sum of $200,000 for the purpose of procuring a water supply and system, and the payment of the contract price for the construction of the system. A preliminary injunction was sought as to the issuance of the bonds, and, after hearing, it was granted in part. A supplemental complaint was filed, seeking to enjoin the performance of the construction contract. Issue was joined by appropriate pleadings on certain of the allegations found in the complaints.
